Eviction Cases in Pakistan Including the Capital

Eviction disputes are common civil cases in Pakistan, including major cities and the capital Islamabad. These cases usually occur when a landlord wants to remove a tenant due to breach of agreement or non-payment of rent. They are governed by Tenancy Laws, Punjab Rented Premises Act 2009, Islamabad Rent Restriction Ordinance, and similar laws in other provinces.

Grounds for Eviction

A landlord can seek eviction on these grounds:

  • Non-payment of rent within the agreed time

  • Subletting the property without consent

  • Violation of the tenancy agreement

  • Landlord’s personal requirement for the property

  • Misuse or damage to the property

Eviction Procedure

  1. Serving Notice
The landlord must serve a written notice stating the reason for eviction and giving reasonable time to vacate.

  2. Filing an Eviction Petition
If the tenant does not comply, the landlord can file an eviction case with the Rent Controller or Civil Court, including courts in Islamabad.

  3. Court Proceedings
The court will issue notice to the tenant for their response. Both parties will present evidence and arguments.

  4. Final Decision
If the claim is valid, the court will order the tenant to vacate. If they do not comply, the landlord can request execution of the order.

Tenant Rights

Tenants have legal protection across Pakistan and in the capital. They cannot be evicted:

  • Without a valid legal reason

  • Without proper notice and court order

  • During tenancy if they meet their obligations

Importance of Written Agreement

A written tenancy agreement registered with the concerned authority is essential. It defines rent, duration, and obligations, which helps avoid disputes.
